    1. NO MEDICAL ADVICE DISCLAIMER (PRIMARY NOTICE)

    HarmoFlux is not a medical professional, therapist, or diagnostic tool.

    • Informational Purposes Only:All content, including AI-generated responses, summaries, and insights, is provided for general wellness and informational purposes only.
    • Consult a Physician:You must always consult with a doctor or qualified medical professional before making any decisions related to your physical or mental health.
    • No Professional Relationship:Use of HarmoFlux does not create a doctor-patient, therapist-patient, or any other professional-client relationship.
    • Emergency Disclaimer:HarmoFlux is not for use in medical emergencies or crises. If you are experiencing a medical emergency or considering self-harm, stop using this app immediately and contact emergency services or a certified crisis hotline.

    2. Eligibility & Account Registration

    • Age Requirement:You must be at least 13 years of age to use this Service. If you are between 13 and 17, you may use HarmoFlux only with the verifiable consent of a parent or legal guardian, who accepts these Terms on your behalf and must authorise any purchase. The Service is not available to anyone under 13.
    • Data Minimization:You agree to provide only an accurate name and email address for billing and account purposes. You are responsible for maintaining the security of your account.

    3. Use of AI and Assumption of Risk

    • AI Nature & Hallucinations:You acknowledge that HarmoFlux utilizes artificial intelligence. AI is an evolving technology and can occasionally produce inaccurate, biased, or false information ("hallucinations").
    • Assumption of Risk:You use AI-generated content entirely at your own risk. HarmoFlux makes no guarantees regarding the accuracy, reliability, or safety of the information provided.
    • No Reliance:You agree not to rely on HarmoFlux to make decisions involving your health, legal status, or financial security.

    4. Billing, Payments, and Subscriptions

    • Platform Supremacy:Where purchases are made through the Apple App Store or Google Play Store, the respective platform's terms and conditions shall govern billing, refunds, and cancellations.
    • Direct Subscriptions:For subscriptions purchased directly via HarmoFlux, fees are non-refundable except as required by law.
    • Record Keeping:As stated in our Privacy Policy, we retain your name and email only for billing and legal compliance.

    5. Prohibited Conduct

    You agree not to:

    • • Use HarmoFlux for any illegal purpose or to generate harmful/hateful content.
    • • Input sensitive medical records or highly personal identifying information (PII).
    • • Attempt to reverse-engineer the AI or bypass any security features.

    6. Limitation of Liability

    To the maximum extent permitted by law, HarmoFlux, its owners, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

    • • Physical or mental injury resulting from the use of the Service.
    • • Decisions made or actions taken in reliance on AI-generated content.

    Cap on Liability: In no event shall HarmoFlux's total liability exceed the amount you paid us for the Service in the six (6) months preceding the claim.

    7. Research Participation and Data Use

    You may be invited to contribute anonymized, aggregated insights for internal research and development purposes as described in our Privacy Policy.

    • Voluntary Contribution:Participation is entirely voluntary, and you may opt-out at any time.
    • No Guarantees:You acknowledge that participation in R&D activities does not guarantee any specific medical outcome, compensation, or personal benefit.
    • License:You grant HarmoFlux a worldwide, perpetual, royalty-free license to use your anonymized, aggregated data for the stated research purposes, provided it adheres strictly to the terms outlined in our Privacy Policy.

    8. Indemnification

    You agree to indemnify, defend, and hold harmless HarmoFlux and its officers from and against any claims, damages, or liabilities (including legal fees) arising from:

    • • Your misuse of the Service.
    • • Your violation of these Terms.
    • • Any actions taken based on your interpretation of AI-generated content.

    9. Intellectual Property

    All software, branding, logos, and original content within HarmoFlux are the exclusive property of HarmoFlux. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

    10. Termination

    We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to our business interests.

    11. Governing Law & Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Ontario, Canada, and the parties hereby consent to personal jurisdiction and venue therein.

    12. Changes to Terms

    We may update these Terms from time to time. Your continued use of the Service after an update constitutes your acceptance of the revised Terms.
